Terms & Conditions

1. The expression the Company mentioned herein after particularly means and shall be deemed to apply to TOP LOGISTICS

2. Unless otherwise agreed all goods are accepted for booking to be transported by Road entirely at the risk and responsibility of consignor and of the consignee.

3. The Company will not receive gold, silver, precious stones, pearls, jewelleries, valuable documents and other varieties of precious cargo and the others and servants of the company are not authorised to receive any such consignment for transportation. If any such property is booked the company shall not be responsible in respect thereof.

4. The company shall not receive or book for transportation the goods or articles contraband by law and are of explosive inflammable, damaging and dangerous in nature unless permitted by the Government and be properly secured and packed but declaration of the nature of such goods has to be given to the company in writing, otherwise such goods and articles will be dealt with as the company may think the consignor shall be bound to make good the company any loss or damage that may occur by such bookings.

5. The company will not be liable for any loss or damage to the goods arising out of & Act of God under unavoidable circumstances and due to riots and civil commotion, robberies, thieves, dacoits heat, fire rain, leakage and any kind of accident whatsoever.

6. The company however, may arrange for insurance cover against loss and or damage to the goods on behalf of the consignor, if required on payment of appropriate premium to be paid to the company along with the freight and other charges.

7. All claims in respect of the consignment will be settled only at Mumbai subject to company’s rule and regulations and conditions for transportation and in accordance with the policy condition of the insurer with whom the consignment is insured by the consignors through the company if no claim for any loss for compensation or non delivery of the entire consignment or it’s part there of is lodged within 45 days from the date of booking of the consignment or within 30 days from the date of receipt of the short Damage Non-delivery Certificate along with original invoice relating to the consignment near the company nor the insurer will be liable or entertain any claim thereof.

8. Unless a certificate in respect of any claim is issued by the Company’s authorised person on the Company’s own printed Short Damage Delivery Certificate, no claim shall be entertained.

9. Issue of any Short Damage Non-delivery Certificates however will not amount to acceptance of claim unless admitted by the company’s office at Mumbai.

10. The Company is not liable to intimate the arrival of the consignment to the Parties, Demurrage will be charged at the rate of 0.02 paisa per Kg per day after 72 hrs of the arrival of the consignment at the destination.

11. Goods perishable liquid, fragile and of breakable nature shall be accepted entirely of Party’s Risk.

12. If a consignment is not taken delivery within two months from the date of arrival at the destination the company reserves the right to sell the goods at the prevailing market price and realize the freight and demurrage charges that may accrue on account of the sales proceeds.

13. The company reserves the right to deviate from its usual route and transport the load by any means it thinks fit.

14. All claims in respect of consignment will cease, if the goods are not taken delivery within 15 days from the date of the arrival of the consignment at the destination or on delivery of the consignment to the consignee whichever shall first occur.

15. The employees, officers and agents of the company are not authorised to alter any of the above terms and conditions.

16. The company will not be responsible for any claim, loss and damage to the OWNER’S RISK consignment and reserves the right to repudiate the claim.

17. Delivery will be effected against the consignee’s copy of this Consignment Note. The possessor of the consignee’s copy of the consignment note will be deemed to be the owner of goods.

18. All disputes, cases and actions are subject to Mumbai Jurisdiction.
